ALLERGYCHEF offers through its website information about food allergies and food intolerances and a service of restaurant management reservations. Users interested in benefit from the restaurant reservation service should have the status of "Registered User", which is acquired by registering on the Website and correctly completing the web form.II.- ACCEPTANCE OF TERMS OF USE
The access or use of the Website attribute the status of user (hereinafter the "User") and implies acceptance without reservation of any kind, by The User of each and every one of the General Conditions and Legal Notice. Logging on to the web and obtaining the Registered User condition means that as a Registered User data you will become part of ALLERGYCHEF files, and their treatment will be as provided in the Privacy Policy. All Registered Users must have at least 14 years. ALLERGYCHEF reserves the right to modify at any time without prior notice, the presentation and configuration of the Website and the Terms and Conditions. You will always have these Conditions in a visible place, freely accessible to all queries want to perform. You will agree to read these Terms each time you access the Website. In any case, acceptance of the Terms and Conditions will be indispensable prior to hiring any service available through the Website.III.- USER OBLIGATIONS
The User must make good use of the content, information and services from the Web, in accordance with Law, these General Conditions, good customs and public order. The User must refrain from practices or customs services for illegal, fraudulent, harmful purposes to the interests of ALLERGYCHEF or third parties. The User agrees not to obstruct the access of other users to access service through massive use of computing resources through ALLERGYCHEF, which provides the service, and not to actions that may damage, interrupt or cause errors in the systems. The User shall refrain from introducing programs, macros, applets, ActiveX controls or any other logical device or character sequence that cause or may cause any type of alteration to the ALLERGYCHEF computer systems or third parties. The data provided in the registration form and introduced in ALLERGYCHEF information systems by the Registered User must be true and accurate, with all the needed updates. Falsehood in the personal data will mean the loss of the status of Registered User. Registered Users are the only responsibles for any false or inaccurate statements made and the damage caused to ALLERGYCHEF or others for the information provided. The Registered User shall be the only responsible for guarding the "user" and "password" provided to ALLERGYCHEF, preventing access by unauthorized third parties to them and thus ensuring confidentiality. In case of loss, theft, identity theft or any indication of the existence of a violation in web security, inappropriate or prohibited uses of the services provided from the same, or security failures of any kind, User must notify ALLERGYCHEF in the e-mail address provided in the heading of this contract.IV.- LIABILITY REGIME
You acknowledge and agree that the use of the Website is at your risk and responsibility, so ALLERGYCHEF will not be responsible for the misuse or abuse of the Website. You acknowledge and agree that, although ALLERGYCHEF makes every effort to ensure technical and factual accuracy of the contents of the website, however they are general and indicative. In this way, ALLERGYCHEF cannot guarantee the accuracy, authenticity, suitability and accuracy of the information provided through the Website. In particular, ALLERGYCHEF will not be responsible for the information provided on the presented restaurants. Consequently, ALLERGYCHEF will not be responsible for decisions made by The User based on the information provided through the Website, or damages caused to The User or third parties for decisions that are taken based on the information obtained from the Website. ALLERGYCHEF shall only be liable for damages incurred by the use of our Website when alleged damages were caused by our own willful misconduct. In particular, ALLERGYCHEF will not be liable for the quality and suitability of the goods and products offered by the restaurants presented on the Website, in which the User chooses to dine, having made the choice of restaurant based on the information provided by our Website or based on the reservation made through our Website, nor is Allergychef liable for the quality of the services provided thereof. Likewise, ALLERGYCHEF is not informed about, nor is involved in, any deficiency in the quality control of the hygiene of the restaurants, and therefore cannot assume any responsibility for errors, carelessness and/or negligence that may occur on their premises, caused by negligence or imprudence of their managers or employees, for whose actions ALLERGYCHEF is not liable.VII.-RESERVATION PROCEDURE
The procedure to make a reservation at a restaurant that takes part of the Website, is as follows: 1. Restaurant Reservation: If you want to book a table at a particular restaurant you should seek the restaurant to which you want to go and check on "Book". Then you must select the schedule and the number of guests for the reservation. 2. User Registration: Then new users must register and fill out a specific form for booking obtaining the condition of Registered User. Registered Users must enter a username and password and then press the button "Finish reservation." 3. Confirmation of receipt of acceptance. Once the reservation process is completed, the Registered User will receive in the email address designated in the registration form, an email confirming the reservation that will contain information related to it. The User may cancel or modify the reservation within a maximum of 2 hours prior to the reservation. To do this, The User may send an email to [email protected], specifying the subject "Right of cancellation" and stating the reservation number. If The User doesn’t go at least at 2 reservations made through the Website without unannounced cancellation, The User will lose the Registered User status. In order to ensure the quality of the service provided, Allergychef may send an e-mail so The User can make an opinion about the experienced provided in the restaurant.VIII.- NOTIFICATIONS
All communications between ALLERGYCHEF and The User relating to these General Conditions or the Website shall be in writing and in accordance with the reporting procedures established in these General Conditions for each case. The email provided by the Registered User shall be employed by ALLERGYCHEF for notifications, declaring all of them valid. ALLERGYCHEF will not be responsible for any damage that may result from the infringement of the Registered User of his obligation to maintain updated the contact details.IX.- PARTIAL NULLITY
If any clause of these General Conditions is held invalid, it shall withdraw or replace. In any case, such declaration of invalidity shall not affect the validity of the remaining provisions in these General Conditions.X.- LAW AND COMPETENT JURISDICTION
Spanish law governs these General Conditions. In the case of litigation or dispute, ALLERGYCHEF and The User agree to submit to the competent courts in accordance with the aforementioned regulations.
